Privacy policy
Subject of this privacy policy
Thank you for your interest in our website. The protection of your personal data while you are on our website is important to us. In the following, we would therefore like to inform you in detail about the data we collect from you when you visit our website and how this data is processed or used.
1. scope of application
This data protection declaration informs users about the type, scope and purpose of the collection and use of personal data by the responsible provider Creative Advantage GmbH, Kaiser-Wilhelm-Straße 115, 20355 Hamburg, Tel. 040 350 177 30, on this website (hereinafter referred to as "offer"). The legal basis for data protection can be found in the Federal Data Protection Act (BDSG), the General Data Protection Regulation (EU-DSGVO) and the Telemedia Act (TMG).
2. access data
The provider collects data on every access to the offer (so-called server log files). The access data includes: Name of the website accessed, file, date and time of access, amount of data transferred, notification of successful access, browser type and version, the user's operating system, referrer URL (the previously visited page), IP address and the requesting provider. The provider uses the log data only for statistical evaluations for the purpose of the operation, security and optimisation of the offer. However, the provider reserves the right to check the log data retrospectively if there is a justified suspicion of unlawful use due to concrete indications.
3. handling personal data
Personal data is information that can be used to identify a person, i.e. information that can be traced back to a person. This includes the name, e-mail address or telephone number. Personal data is only collected, used and passed on by the provider if this is permitted by law or the users consent to the data collection.
We do not collect any personal data via our websites without your consent. You alone decide whether or not you want to disclose this data to us, for example as part of a registration or survey. We need your personal data to answer your enquiry, process your order or provide you with access to special information or offers. We will not sell or otherwise market your personal data to third parties.
You can revoke your consent to the collection, processing and use of your personal data at any time.
4. contacting
When contacting the provider (for example via contact form or e-mail), the user's details are stored for the purpose of processing the enquiry and in the event that follow-up questions arise.
5. comments and contributions
When users leave comments on the blog or other posts, their IP addresses are stored. This is done for the security of the provider in case someone writes illegal content in comments and posts (insults, forbidden political propaganda, etc.). In this case, the provider itself can be prosecuted for the comment or post and is therefore interested in the identity of the author.
6. e-mail / newsletter
By completing a registration form on our website, you agree to receive emails from Creative Advantage GmbH. In these emails, we inform you about our consulting services and provide content requested by you. For this purpose, we require a valid e-mail address from you as well as information that allows us to verify that you are the owner of the specified e-mail address or that its owner agrees to receive the e-mails. In addition, we may request further data for the personalisation of our e-mails. No other data is collected. This data is only used for sending the e-mails and is not passed on to third parties. When you register for our e-mails or request our content, we store your IP address and the date of registration. This storage is solely for the purpose of providing evidence in the event that a third party misuses an e-mail address and registers to receive e-mails without the knowledge of the authorised person. The data entered is transmitted via an SSL-encrypted connection. You can revoke your consent to the storage of data, the e-mail address and its use for sending e-mails at any time. The revocation can be made via a link in the e-mails themselves or by sending a message to the contact options above.
Notes on e-mails and consents
The following information explains the contents of our e-mails as well as the registration, dispatch and statistical evaluation procedures and your rights of objection. By subscribing to our emails, you agree to receive them and to the procedures described.
Double opt-in and logging
Registration for our e-mails takes place in a so-called double opt-in process. This means that after registration you will receive an e-mail asking you to confirm your registration. This confirmation is necessary so that no one can register with other people's email addresses. The registrations to our e-mails are logged in order to be able to prove the registration process in accordance with the legal requirements. This includes the storage of the registration and confirmation time as well as the IP address.
Content of the emails
We only send e-mails and other electronic notifications with promotional information with the consent of the recipients or with legal permission. If the contents of the e-mails are specifically described in the context of a registration, they are decisive for the consent of the users. In addition, our e-mails contain information about our advisory services and our company (this may include, in particular, references to the delivery of digital content, blog posts, lectures or workshops, our services or online presences).
Use of the "ActiveCampaign" mailing service provider
The e-mails are sent using "Activecampaign", an e-mail sending platform of the US provider ActiveCampaign, LLC, 1 N Dearborn, 5th Floor, Chicago, IL 60601, USA.
The email addresses of our recipients, as well as their other data described in this notice, are stored on ActiveCampaign servers in the USA. ActiveCampaign uses this information to send and evaluate the emails on our behalf. Furthermore, according to its own information, ActiveCampaign may use this data to optimise or improve its own services, e.g. for the technical optimisation of the dispatch and presentation of the newsletter or for economic purposes in order to determine from which countries the recipients come. However, ActiveCampaign does not use the data of our email recipients to write to them itself or pass the data on to third parties.
We trust in the reliability and IT and data security of ActiveCampaign. ActiveCampaign is certified under the EU-US Privacy Shield and is therefore committed to complying with EU data protection regulations. You can find ActiveCampaign's data protection policy here. In addition, ActiveCampaign protects our newsletter subscribers with a comprehensive anti-spam policy.
Login data
To register for our emails, it is sufficient in most cases to provide an email address. In individual cases for the delivery of more extensive content, first and last name as well as your company/organisation and position are required.
Statistical survey and analyses
The emails contain a so-called "web beacon", i.e. a pixel-sized file that is retrieved from the ActiveCampaign server when the emails are opened. Within the scope of this retrieval, technical information, such as information about the browser and your system, as well as your IP address and the time of the retrieval are initially collected. This information is used for the technical improvement of the services based on the technical data or the target groups and their reading behaviour based on their retrieval locations (which can be determined with the help of the IP address) or the access times.
The statistical surveys also include determining whether the newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to individual newsletter recipients. However, it is neither our intention nor that of ActiveCampaign to observe individual users. The analyses serve us much more to recognise the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.
Online call and data management
There are cases where we direct the email recipients to ActiveCampaign's websites. E.g. our e-mails contain a link with which the recipients can retrieve the e-mails online (e.g. in case of display problems in the e-mail programme). Furthermore, recipients can subsequently correct their data, such as the e-mail address. Likewise, ActiveCampaign's privacy policy is only available on their site.
In this context, we pointed out that cookies are used on the websites of ActiveCampaign and that personal data is processed by ActiveCampaign, its partners and service providers (e.g. Google Analytics). We do not have any influence on this data collection. We would also like to draw your attention to the options for objecting to the collection of data for advertising purposes on the websites https://www.aboutads.info/choices/ and https://www.youronlinechoices.com/ (for the European region).
Termination / Revocation
You can cancel the receipt of our emails at any time, i.e. revoke your consent. Your consent to the sending of e-mails via ActiveCampaign and the statistical analyses will then expire at the same time. Separate cancellation of the sending via ActiveCampaign or the statistical analysis is not possible. You will find a link to cancel the e-mails at the end of each e-mail.
7. integration of services and contents of third parties
It may happen that third-party content, such as videos from YouTube, maps from Google Maps, RSS feeds or graphics from other websites, are integrated within this online offer. This always assumes that the providers of this content (hereinafter referred to as "third-party providers") are aware of the IP address of the user. Without the IP address, they could not send the content to the browser of the respective user. The IP address is therefore necessary for the presentation of this content. We endeavour to only use content whose respective providers only use the IP address to deliver the content. However, we have no influence if the third-party providers store the IP address, e.g. for statistical purposes. Insofar as this is known to us, we inform the users about this.
Cookies
Cookies are small files that make it possible to store specific, device-related information on the user's access device (PC, smartphone or similar). On the one hand, they serve the user-friendliness of websites and thus the users (e.g. storage of login data). On the other hand, they serve to collect statistical data on website use and to be able to analyse it for the purpose of improving the offer. Users can influence the use of cookies. Most browsers have an option to restrict or completely prevent the storage of cookies. However, it is pointed out that the use and in particular the user comfort will be limited without cookies. You can edit many online ad cookies from companies via the US site http://www.aboutads.info/choices/ or the EU site http://www.youronlinechoices.com/uk/your-ad-choices/ .
Registration function
The data entered during registration is used for the purpose of using the offer. Users may be informed by e-mail about information relevant to the offer or registration, such as changes to the scope of the offer or technical circumstances. The data collected can be seen from the input mask within the scope of registration. This includes all information entered when purchasing or requesting an offer that leads to registration on this offer.
Google Analytics
This website uses Google Analytics, a web analytics service provided by Google Inc, (1600 Amphitheatre Parkway Mountain View, CA 94043, USA; "Google"). The use includes the "Universal Analytics" mode of operation. This makes it possible to assign data, sessions and interactions across multiple devices to a pseudonymous user ID and thus to analyse the activities of a user across devices. This data protection notice is provided by www.intersoft-consulting.de.
Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyse how users use the site. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. In the event that IP anonymisation is activated on this website, however, your IP address will be truncated beforehand by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator. Our legitimate interest in data processing also lies in these purposes. The legal basis for the use of Google Analytics is § 15 para. 3 TMG and Art. 6 para. 1 lit. f DSGVO. The data sent by us and linked to cookies, user IDs (e.g. user ID) or advertising IDs are automatically deleted after 14 months. The deletion of data whose retention period has been reached takes place automatically once a month. For more information on terms of use and data protection, please visit https://www.google.com/analytics/terms/de.html or https://policies.google.com/?hl=de.
You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. In addition, you can prevent the collection of the data generated by the cookie and related to your use of the website (incl. your IP address) to Google as well as the processing of this data by Google by downloading and installing the browser add-on. Opt-out cookies prevent the future collection of your data when visiting this website. To prevent the collection by Universal Analytics across different devices, you must perform the opt-out on all systems used.
Podcast hosting
We use the podcast hosting service Podigee from the provider Podigee GmbH, Ritterstraße 2A, 10969 Berlin, Germany. The podcasts are loaded by Podigee or transmitted via Podigee. The use is based on our legitimate interests, i.e. interest in a secure and efficient provision, analysis and optimisation of our podcast offer pursuant to Art. 6 para. 1 lit. f. DSGVO. Podigee processes IP addresses and device information to enable podcast downloads/playbacks and to determine statistical data, such as call-up figures. This data is anonymised or pseudonymised before being stored in Podigee's database, unless it is necessary for the provision of the podcasts.
Further information and objection options can be found in Podigee's privacy policy: https://www.podigee.com/de/about/privacy/.
8. revocation, changes, authorisations, updates and deletion
The user has the right, upon request and free of charge, to obtain information about the personal data stored about him/her. In addition, the user has the right to correct incorrect data, block and delete his or her personal data, insofar as this does not conflict with a legal obligation to retain data.
Consent to receive our emails can be revoked at any time by sending an email to kontakt@creative-advantage.de, by post or by fax. In addition, you will find an unsubscribe link in every marketing e-mail with which you can revoke your consent.
